FAYETTEVILLE, Ark. – Residents at the HighPoint apartment complex in Fayetteville say they are frustrated with their living conditions and the way management is handling the situation by not offering any solutions to the problem.

“Because the tenants here have been struggling with problems for months and some have had system-related sanitary problems here for years. The site is not well maintained and people just want results and they want the ability to negotiate with their property manager,” said Arkansas Renters United’s Billy Cook.

Ryan and Kristin Fortner have lived there for almost a year and say they’ve had problems since moving in.

“Sewage came out of our bathtub until the tub started overflowing with human feces and urine, and it came out of our floorboards … almost every inch of the house,” Kristin Fortner said.

The Fortners said they made several appointments with management but were caught off guard. The couple said they couldn’t move because it was difficult to find affordable housing.

“The truth is we have nothing to do, we have no choice but to live in human excrement or stand up and fight for ourselves,” said Ryan Fortner.

These residents aren’t the only ones fighting for changes in the complex. On July 26, Ana Gaston’s apartment caught fire.

“So I was trying to put out the fire and everyone was yelling at me to get out of the apartment because you couldn’t see anything, the smoke was so thick,” Gatson said.

He said after the fire, management canceled his lease and evicted him for allegedly not paying July’s rent.

“I can’t believe they’re telling me that when I have two kids, they’re going to end my lease and throw us out on the street… I canceled my lease in March, so I’m a tenant here… I pay my rent regularly.” said Gatson.

Gaston said he paid July’s rent twice and paid for August if he could move to an empty apartment. But he had no money order documents.

“They don’t have any paperwork… allegedly I never paid my rent for the month of July, which I did. But you say my documentary caught fire. So, I mean, I don’t know what they did to my July rent,” Gatson explained.

During this time, Gaston and his children go back and forth between staying at his friend’s house and his parents’. After school, it is not easy for her as a single mother.

“I miss… I want to have a home. My daughter told me this morning before getting on the bus that she missed having a home and wished we had somewhere to go,” Gaston said.

Billy Cook of Arkansas Renters United said they sent this report to the City of Fayetteville and the United States Department of Housing and Urban Development (HUD). They have plans to send it to elected officials as well.

5NEWS spoke to the property manager today who said he is new to management and is trying to catch up. We also tried to speak to his manager, who refused to comment.

Employees at Farrell’s Lounge on Dickson Street received a $50,000 donation from Ally Bank during halftime of the Arkansas game. The bank also picked up the bill for each customer at the restaurant on Thursday evening.

Farrell chef John Shorter has been at the restaurant for two years after plans to play music across the country were abruptly halted by the COVID-19 pandemic.

TikToker Dean Saramo (@deanobballin24) announced the surprise before snapping some of his famous shots. He’s unrelated to Arkansas but wants to make our Sweet 16 win even sweeter.

“Cheer up,” he said. “It’s going to be a tough few days, honestly, but you have to stay strong and you’ll get through it.”

“I’m so happy,” said Megan Gardner, a waitress at Farrell’s. “I’m amazed that this happened. This is by far the most money I’ve ever made in a shift.”

He is a student at the University of Arkansas and said that money will be used to pay for his schooling.

Ally Bank wants to celebrate restaurant employees who have worked through the March Madness. Ally is a digital financial services company.
